General Terms and Conditions for Quero Wallet Services
1. Introduction
These General Terms and Conditions (“General Terms”) define the agreement between you (“Client” or “you”) and Quero, including any of its subsidiaries or affiliates (“Quero” or “we”). This agreement governs your use of Quero’s Wallet Services and establishes a legally binding relationship between you and Quero (collectively, the “Parties”).
Please read these Terms carefully. By using any Quero service—including just signing up—you agree to these Terms and enter into a contractual relationship with Quero.
2. Definitions
- Applicable Law: Any law, regulation, rule, directive, or legal requirement issued by a government or regulatory authority.
- Business Day(s): Days banks are open for business in your jurisdiction, excluding weekends and public holidays.
- Digital Assets: Cryptocurrencies or stablecoins supported by Quero. These may change over time.
- Fork: A change in the protocol of a blockchain network, possibly creating new versions of a Digital Asset.
- Intellectual Property: All intellectual and industrial property rights owned by Quero, including trademarks, copyrights, and brand materials.
- Quero Account: Your personal or business account registered with Quero.
- Quero Card: A virtual or physical card issued by Quero, usable in supported regions.
- Quero Exchange Service: A feature allowing conversion of Digital Assets, with proceeds credited to your Quero Account.
- Quero Platform: Official Quero websites, apps, and communication channels.
- Quero Wallet Services: Services provided through the Quero Platform related to managing Digital Assets.
- Personal Data: Information required to verify your identity or comply with legal obligations.
3. Quero Wallet Services
Quero Wallet Services include:
- A secure Digital Asset Wallet for storing supported assets.
- Exchange Services to convert Digital Assets.
- Transfers between Quero accounts or to external wallets.
- Incentive Programs such as rewards or promotions.
- Future Services that may be added via the Platform.
Some services may not be available in specific regions or for certain users.
Your Quero Account lets you:
- Request services
- View your balance and transaction history
- Top up, withdraw, or transfer Digital Assets
- Use other available features
4. Opening a Quero Account
By creating an account or using Wallet Services, you confirm:
- You are the sole owner of the Digital Assets and are not acting for anyone else.
- You comply with all laws relevant to your use of these services.
- You accept the Privacy Policy and Cookies Policy.
You may not:
- Open more than one account.
- Open a new account if a previous one was suspended or terminated.
Verification:
- You must provide accurate documents and information.
- Quero may verify your details using secure databases.
- Quero can conduct electronic ID checks at any time.
We may refuse service at our discretion.
You must:
- Keep your information accurate and up-to-date.
- Notify us of any changes immediately.
Failure to do so may limit your access to our services.
Security:
- You are responsible for the security of your devices and login credentials.
- Notify us immediately if your device is lost or your account is compromised.
5. Adding Digital Assets
You can top up your wallet by transferring Digital Assets from your personal wallet.
Ensure:
- You use the correct wallet address.
- You only transfer supported Digital Assets.
Incorrect transfers may result in permanent loss, and Quero is not responsible for these losses.
Confirmation: Transfers are complete once the balance updates in your wallet. Quero may reject and return a transfer.
Purchasing Assets:
- Use a credit or debit card.
- Instruct Quero to make a purchase through its exchange service.
Fees may apply. All transactions are final and irreversible.
6. Withdrawing Digital Assets
You may withdraw your Digital Assets (excluding collateralized ones) to your personal wallet.
- Limits: Set by Quero and subject to change.
- Processing Time: Typically within a few days.
- Large withdrawals: May take up to 72 hours.
7. Transferring Digital Assets
You may transfer supported Digital Assets to other users or external wallets.
- Responsibility: Ensure all information is correct.
- Irreversible: Transfers cannot be undone once processed.
- Balance: Your wallet must have enough assets to complete the transfer.
Quero is not responsible for third-party goods/services or disputes. You must resolve these directly.
8. Risk Disclosure
Digital Assets are highly volatile and risky. Their value can fluctuate significantly.
- Not legal tender: They are not government-backed.
- Market-dependent: Value relies on user demand. In some cases, they may become worthless.
- Regulatory changes: Laws may affect your ability to use or transfer assets.
Transactions are usually public, irreversible, and susceptible to cybersecurity risks.
Quero does not offer financial advice. Use at your own risk.
You are responsible for ensuring that use of these services is legal in your country.
9. Forks
A fork may result in multiple versions of a Digital Asset. Quero may temporarily suspend services to assess which version to support.
We are not obligated to support any specific fork. Unsupported assets may be retained by Quero without compensation to you.
10. Your Responsibilities and Warranties
You confirm:
- You follow all requirements listed above.
- Your assets are not from illegal sources.
- Your information is accurate.
- You are responsible for your taxes.
You agree to:
- Use our services lawfully.
- Avoid fraud or abuse.
- Protect your login details and prevent unauthorized access.
11. Quero Affiliate Program
You may refer new clients through our affiliate program.
- Referrals must be new users.
- Participation is non-transferable.
- Quero may change the program at any time.
12. Suspension or Termination of Services
Quero may limit or stop services if:
- You violate these terms.
- Required by law.
- Fraud or illegal activity is suspected.
- Maintenance or technical issues occur.
Suspended accounts may freeze assets. Quero is not liable for any losses.
13. Personal Data
Your data is processed per our Privacy and Cookies Policies. If you close your account, Quero may still retain data to meet legal obligations.
14. Limitation of Liability
- “As Is” Services: Wallet Services are provided without warranties unless expressly stated.
- No Liability: Quero Card is not liable for losses resulting from external events (e.g., force majeure, system interruptions, unauthorized access, regulatory compliance).
- Indirect Damages: Quero Card is not responsible for incidental, punitive, or consequential damages (e.g., lost profits, data loss).
- Liability Cap: Aggregate liability is limited to the fees you paid to Quero Card in the 12 months preceding the event causing the claim.
15. Default and Indemnification
If you breach these terms or act unlawfully:
- Quero may terminate your account.
- You agree to cover any costs or damages we incur as a result.
16. Termination
Either party may end this agreement. If your account is closed, you may recover remaining assets unless prohibited by law.
17. Communication
We may contact you by email, phone, or mail. You must communicate with us in English and ensure your contact information is up-to-date.
18. Governing Law
These Terms follow the laws of Quero’s operating jurisdiction. Any legal disputes will be handled by the appropriate courts in that region.
19. Miscellaneous
- Fees: Service fees exclude taxes and may change.
- Intellectual Property: All rights are owned by Quero.
- Amendments: Terms may be updated and become effective upon publication.
- Severability: Invalid terms do not affect the rest of the agreement.
- No fiduciary duty: Quero does not act as your advisor.
- Assignment: We may transfer this agreement without notice; you may not without our consent.
- Language: The English version is the official and binding version.
